NOTICE OF LIMITED LIABILITY AND CLAIMS PROCEDURE

Smrt Tek, LLC (the “Company”) is a limited liability company organized under the laws of the State of Alaska. The Company’s members and managers are not personally liable for the debts, obligations, or liabilities of the Company, including any claims arising from services performed, to the fullest extent permitted by applicable law.

Services and Warranty Disclaimer All services provided by the Company are performed in a professional manner using reasonable care and skill consistent with industry standards. However, services are provided “AS IS” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or that the services will achieve any specific result or outcome. The customer assumes all risk associated with the use or results of the services.

Claims Procedure and Limitation Period Any issues, defects, deficiencies, or complaints related to the work or services performed must be brought to the Company’s attention in writing within thirty (30) calendar days after the completion of the services or delivery of the final work product (whichever occurs first).

Written notice must include a detailed description of the issue, supporting documentation (such as photos or records), and the customer’s contact information. Failure to provide timely written notice within this 30-day period constitutes acceptance of the services as complete and satisfactory. After this period, the Company shall have no further obligation to correct, repair, or address any alleged issues, and the customer waives any claims related to the services.

Limitation of Liability To the fullest extent permitted by law, the Company’s total liability arising out of or related to the services (whether in contract, tort, negligence, or otherwise) shall not exceed the total amount actually paid by the customer to the Company for the specific services at issue. In no event shall the Company be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, business interruption, loss of data, or any other economic loss, even if advised of the possibility of such damages.

This notice does not limit the Company’s liability for gross negligence, willful misconduct, or as otherwise prohibited by applicable law.

Governing Law This notice and any related agreement shall be governed by the laws of the State of Alaska.

By engaging the Company for services, the customer acknowledges receipt and acceptance of this notice.
